お客様は、ノース・スノーランド㏌千歳（以下「当サイト」といいます。）のサービスを利用することにより、本利用規約を読み、理解し、本利用規約に拘束されることに同意したことになります。お客様が本利用規約のいずれかに同意いただけない場合、当サイトのサービスをご利用いただけませんので、その旨ご理解ください。

  2. 本利用規約は、お客様と当サイトとの間の本サービスの利用に関する契約（以下「本サービス利用契約」といいます。）の内容となります。本サービスのいずれかを利用する場合、お客様は、本利用規約、当サイトのプライバシーポリシーその他の当サイトが本プラットフォーム上、又はオフラインにおいて定める当該サービスに適用される条件に拘束されることに同意するものとします。これらの条件は、すべて本サービス利用契約の内容となります（本利用規約とこれらの条件を総称して「本利用規約等」といいます。）。
  3. 当サイトは、関連する法律により要求されるか、又は当サイトが必要と判断する場合、お客様への予告なく、いつでも、民法第548条の4の規定に従い、本利用規約を改正又は更新することができます。本利用規約に変更が生じた場合は、最新版を本プラットフォーム（.rezio.shop）に掲載し、本利用規約が最後に更新された日付を表示します。お客様は、本利用規約の更新後に引き続き本サービスを利用することにより、更新された本利用規約に同意したものとみなされます。本サービスをご利用の際は、最新の本利用規約をご確認ください。

第2条 本サービスの内容
  1. 本サービスでは、本プラットフォームを通じて、当サイト又はサプライヤーが提供する観光サービスを簡単かつシンプルに選択し、予約・購入することができます。お客様は、個人が利用・参加する目的でのみ、本サービスを通じて観光サービスを予約・購入することができ、第三者への転売目的その他営利目的により本サービスを利用してはなりません。
  2. 本サービスを通じてお客様による観光サービスの予約・購入が確定した場合、本プラットフォーム上の表示に従い、お客様と当サイト、または、お客様とサプライヤーとの間で、当該観光サービスの利用に関する契約が成立することになります。
  3. 当サイトは、本サービス及び本プラットフォームの運営維持に努めますが、本サービス及び本プラットフォームが常に正常に機能し、又は外部要因により中断されないことを保証するものではありません。お客様は、当サイトが、お客様による本プラットフォームへのアクセス又は本サービスの利用を拒否する権利を有し、また、本サービス又は本プラットフォームを変更、停止、中止又は終了する権利を有することに同意します。

第3条 プラットフォームコンテンツ
  1. 本利用規約において、「プラットフォームコンテンツ」とは、当サイトが本プラットフォーム上で掲載又は使用するすべての素材（テキスト、写真、図形、画像、イラスト、映像、音声、データ、コードその他の素材を含みますがこれらに限定されません。）を意味します。お客様は、すべてのプラットフォームコンテンツが、当サイト又は当該素材の使用を当サイトに対して許諾するライセンサー（以下、総称して「当サイト等」といいます。）が権利を有するものであり、関連する知的財産法によって保護されていることを確認します。当サイトは、お客様への予告なしにプラットフォームコンテンツを変更、修正又は削除する場合があります。
  2. 当サイトは、お客様が本利用規約等を遵守することを条件として、お客様に対し、本プラットフォームを利用し、アクセスするための限定的、非独占的かつ譲渡不能なライセンスをお客様に付与することに同意するとともに、お客様への事前の通知なく、いつでも当該ライセンスを取り消すことができるものとします。お客様は、関連する知的財産法及びその他の適用法令を遵守し、個人的、非営利的な目的のためにのみプラットフォームコンテンツを使用し、これにアクセスすることに同意します。お客様は、いかなる場合においても、当サイト等に損害を与えるような方法で、プラットフォームコンテンツを使用、複製、翻訳、送信、放送、販売、譲渡せず、また、プラットフォームコンテンツに基づく二次的著作物を創作しないことを確約します。お客様は、いかなる形式においても、プラットフォームコンテンツを大量に複写、保存又はダウンロードしないことを確約します。さらに、お客様は、お客様がプラットフォームコンテンツを利用し又はこれにアクセスすることにより生じるすべてのリスク（当サイト等の損害を含みます。）についてその責任を負うことに同意します。法律で認められる最大限の範囲において、当サイトは、プラットフォームコンテンツの誤り又は不備を含みますがこれらに限定されず、プラットフォームコンテンツにつき一切責任を負いません。お客様は、ご自身のプラットフォームコンテンツの利用又はアクセスにより第三者が被った損失又は損害に対しても、単独で責任を負うものとします。
  3. お客様は、プラットフォームコンテンツを利用し又はこれにアクセスする過程で、お客様がやり取りする第三者を当サイトが認識すること、及び、当該第三者の行動を当サイトが予測し、又は、管理することができないことを確認し、これに同意します。そのため、当サイトは、本プラットフォームを介して他の第三者からお客様に提供されるコンテンツ、資料又は情報の信頼性及び正確性を保証することはできません。

第4条 お客様から提供される情報の取扱い
  1. お客様は、当サイトのプライバシーポリシーに従い、当サイトがお客様の個人情報を使用することに同意します。
  2. 当サイトは、お客様の意見を収集して本サービス及び観光サービスを改善するために、お客様に対し、SMS、Eメール又は本プラットフォームを通して観光サービスのレビューのを依頼することがありますが、レビューを行うか否かはお客様自身の判断で決定することができます。当サイトは、お客様のレビューを受領した場合、当該レビューを本プラットフォームの関連ページにアップロードし、お客様の満足度及び意見を共有、公開することができます（ただし、共有、公開する義務を負うものではありません。）を有します。お客様は、自らが提供するレビューにおいて、誤解を招く表現、不適切、中傷的、脅迫的、虐待的その他の他人に不快な思いを抱かせる表現を用いてはならず、また、お客様又は第三者の個人情報、お客様が実際に利用した観光サービスとは無関係な情報、及び法令等又は本利用規約等に違反する内容を含めてはなりません。
  3. お客様は、お客様が提供するレビュー（テキスト、写真、画像及び映像を含みますがこれらに限定されません。）について、関連する知的財産法に基づく著作権のすべての要素を満たしているか否かにかかわらず、当サイトが、サプライヤー、本プラットフォームを当サイトに提供する会社（以下「本プラットフォーム提供者」という。）又は本プラットフォームの利用者によって使用される場合があることを理解し、これに同意します。したがって、お客様は、当サイトにレビューを提供した場合、当該レビューについて、以下の事項について、取消不能の形で同意したこととなります。
    (a) 非独占的で、無償かつ無期限の、世界全域で有効かつサブライセンス可能な条件にて、当サイト、サプライヤー又は本プラットフォーム提供者が複製、変更、引用、修正、翻訳、二次的著作物の創作を行い、又はその他の方法で使用することを許可すること（あらゆる媒体での宣伝を含みますがこれらに限定されません。）。
    (b) 本プラットフォームの利用者に対し、本プラットフォームを通して非営利目的でアクセス、利用、複製、二次的著作物の創作を行い、又はその他の方法で合理的に使用することを非独占的に許可すること。
ただし、お客様による許可は、お客様の書面による別段の同意がない限り、お客様が提供する情報の所有権に影響を及ぼしません。
  4. お客様は、自らが提供するすべての情報（テキスト、写真、図形及び映像を含みますがこれらに限定されません。）が、いかなる法令等にも違反せず、いかなる第三者の権利も侵害しないこと、本利用規約等に違反しないこと、及び当サイト、サプライヤー、本プラットフォーム提供者及び本プラットフォームの利用者が、かかる情報を使用することによりいかなる第三者の権利も侵害しないことを保証します。お客様は、自らが提供するすべての情報に対して一切の責任を負うことを認め、当サイトはお客様が提供した情報の誤り又は不備に対して何ら責任を負いません。
  5. 当サイトは、独自の判断で、お客様が当サイトに提供したレビューその他の情報を本プラットフォームから削除することができ、これについて異議なく承諾します。

第5条 お客様の誓約事項
  1. お客様は、本利用規約等に全面的に従って本サービス、本プラットフォーム及び観光サービスを利用するものとします。お客様は、本サービス、本プラットフォーム及び観光サービスの利用における自らのすべての行為について単独で責任を負うものとします。
  2. お客様は、以下の各事項を遵守することを誓約します。
    (a) お客様は、当サイトの書面による事前の承諾なしに、本サービスの一部を複写、複製、配布、公表、開示、実行、送信又は放送してはなりません。例として、当サイトの書面による明示的な事前の承諾を得ることなく、次のような行為を行うことを含みますが、これらに限定されません。
      (i) 本サービスを利用するうえで認められているソフトウェアを変更、改変、切断その他迂回する行為。
      (ii) プラットフォームコンテンツを自己又は第三者のために使用する行為。
    (b) お客様は、本サービスのセキュリティ・情報管理等に関する機能を、迂回、破損若しくは妨害しないこと、又は、本来の利用方法とは異なる方法で本サービスにアクセスし若しくはこれを利用してはなりません。
    (c) お客様は、本利用規約等又は法令等において許可される範囲を除き、本サービス又は本プラットフォーム（これらを通じて利用可能なサービスを含みます。）、デコンパイル、リバースエンジニアリング、逆アセンブル若しくはハッキングを行い、依頼し、承認し、若しくはこれらの行為を試み、又は当サイトが意図する以外の方法で本サービス又は本プラットフォームの一部を利用し若しくはこれにアクセスしようとしてはなりません。
    (d) お客様は、当サイトが本サービス又はサービス内容の一部を組み込む手段を利用可能とする場合を除き、他のアプリケーション又はウェブサイトを通じて、本サービス（本サービス又はその一部で利用可能なサービス内容を含みます。）を利用、表示、ミラーリング、フレーミングし、又はこれを開示するためのフレーミング技術を利用してはなりません。
    (e) お客様は、本サービス、当サイト（及び当サイトにホスティングサービスを提供する会社）のコンピュータシステム及びインフラ、又は当サイトのプロバイダーの技術配信システムにおける非公共領域にアクセスし、手を加え、又はこれを使用してはなりません。
    (f) お客様は、当サイト、本プラットフォーム提供者、サプライヤーの役職員、及び、本プラットフォームの他の利用者を含む第三者に対して嫌がらせをし、罵倒し、若しくは危害を加え、又は他人によるそれらの行為を支持し若しくは誘発させてはなりません。
    (g) お客様は、いかなる方法においても、当サイト又はサプライヤーに対し、虚偽の個人情報を提供し、虚偽の識別情報を作成及び提供し、又は第三者になりすましてはなりません。
    (h) お客様は、本プラットフォームの他の利用者に対し、個人情報の提供を求めるか、又は求めようとしてはなりません。
    (i) お客様は、第三者に対して本サービスの利用を制限、阻止又は禁止せず、本サービスより取得した第三者に関する個人情報を当該第三者の同意なしに開示してはならず、また、本プラットフォームの他の利用者に関する情報を収集してはなりません。
    (j) お客様は、本利用規約において明示的に許可される場合を除き、商業広告又は勧誘を通知又は促進するために本サービスを利用してはなりません。
    (k) お客様は、詐欺行為、本プラットフォームの情報セキュリティ違反、他の利用者のパスワードの解読、データの転送若しくは不正保存、又はその他のいかなる違法行為も行ってはなりません。

第6条 注文確認及び返金ポリシー
  1. お客様は、本プラットフォームを通じて、所定の通貨により、当サイト又はサプライヤーが提供する観光サービスを選択し、予約／注文することができます。予約／注文と同時に予約／注文が確定することが明示された予約／注文を除き、その他の予約／注文は、その後、当サイト又はサプライヤーによる在庫、空席等の確認が必要となります。お客様は、SMS、Eメール又はモバイルアプリケーションにより、確認結果についての通知を受領することに同意します。また、お客様の予約／注文の結果の返信に要する時間として本プラットフォームに表示された時間は、あくまでも参考のためのものであることを確認し、同時間内に結果を通知することを約束するものではありません。また、お客様は、お客様の予約／注文の確認に要する時間が、実際の状況に応じて調整される場合があることを確認します。
  2. 当サイトは、当サイト又はサプライヤーが提供する観光サービスの価格及び料金をいつでも変更又は調整する権利を有します。上記の変更は、本プラットフォーム上で表示する他、SMS、Eメール、ウェブサイト及びモバイルアプリケーションを介して通知される場合があります。お客様は、当該変更の通知後に本サービスを利用した場合、変更された価格及び料金に同意し、承諾したものとみなされます。但し、変更の通知前に、予約／注文が確定していた観光サービスについては、従前の価格及び料金が適用されます。
  3. お客様が、本利用規約等に違反したときは、当サイトは、何らの催告をすることなく、お客様の観光サービスの予約／注文を拒否又はキャンセルすることができます。
  4. お客様は、当サイト所定の支払方法により、観光サービスの料金を当サイトに対して支払うことに同意します。お客様は、当サイト所定の支払手続に従って支払を完了するまで、当サイトが、お客様に対して観光サービスを提供する義務を負わないことを確認し、これに同意します。本利用規約等に別段の定めがない限り、お客様が支払った観光サービスの価格、料金は返金不可となります。
  5. お客様が予約／注文した観光サービスが、当サイトではなくサプライヤーが提供するものである場合、当該サプライヤーは、お客様の予約／注文をその裁量により承諾又は拒否することができ、また、承諾したときは、第2条第2項に従い、お客様とサプライヤーとの間で、観光サービスの利用に関する契約が成立するものとします。この場合、お客様に対して観光サービスを提供する責任は、サプライヤーのみが負い、当サイトはその責任を負いません。お客様が、サプライヤーからのサービスの内容について質問がある場合、まずサプライヤーに問い合わせることで最も直接的な情報を得ることができますが、当サイトにご連絡いただければ、解決策を見つけるために当サイトがサプライヤーに連絡を試みます。
  6. お客様は、サプライヤーによって提供される特定の観光サービスについて、実際の状況に応じて追加の税金又は手数料及び費用が発生する場合があること、並びに、お客様が当該金額をサプライヤー又は税務当局に直接支払う義務を負う可能性があることを確認し、これに同意します。当サイトは、サプライヤーに対し、提供するサービスに関する最新かつ正確な利用条件、制約、価格その他の情報の提供を要求していますが、当サイトが、サプライヤーが本プラットフォームに掲載するすべての内容が常に正確であることを保証することはできません。お客様の注文／予約がサプライヤーによってキャンセルされた場合、当サイトは合理的な方法で可能な限り速やかにお客様にお知らせします。
  7. ①お客様が、予約／注文の際に本プラットフォーム上に表示されたキャンセルポリシーに従いキャンセル手続を完了した場合、又は、観光サービスの催行条件その他の提供条件が達成されなかったことにより、当サイト若しくはサプライヤーがキャンセルをした場合、お客様が支払った金額は、その支払時に使用した決済方法と同一の方法により、お客様に返金されます。お客様は、受領する返金額が、為替レート、又はクレジットカード会社若しくは決済処理業者が徴収する管理手数料若しくはサービス手数料により、お客様が当初支払った金額と異なる場合があることを十分に認識し、これに同意します。
  8. Eバウチャーの使用
    (1) お客様は、本プラットフォームを介して観光サービスを選択し、予約／注文する場合、予約／注文が確定した後、有形のバウチャーが提供される場合等を除き、予約／注文番号及びお客様が購入した観光サービスを表示した電子バウチャー（以下「Eバウチャー」といいます。）を含む、予約／注文内容の確認するSMS又はEメールを受け取ることになります。お客様は、観光サービスを利用する際には、かかるEバウチャーを印刷して、観光サービスの提供場所において持参する必要があります。
    (2) お客様は、当サイト及びサプライヤーが定めるEバウチャーの利用条件を遵守しなければならず、これに同意します。これには、お客様本人が、E-バウチャー記載の利用期間内に、当サイト又はサプライヤーが指定する場所に定刻どおりに現れ、当サイト又はサプライヤーが要求する文書又は資料（例えば、お客様の写真付きの身分証明書、注文番号／予約番号、Eバウチャー等）を提示しなければならないことなどを含みます。お客様は、Eバウチャーの利用条件を遵守できない場合、Eバウチャー記載の観光サービスの提供を受けることができず、また、この場合には返金は一切認められません。
    (3) お客様は、自身のEバウチャー又は予約／注文番号が紛失若しくは盗難に遭ったとしても、当サイト又はサプライヤーが、Eバウチャーを再発行し、又はEバウチャーに記載される観光サービス内容をお客様に提供する義務を負わないことを確認し、これに同意します。また、お客様がEバウチャーをその利用条件、本利用規約等又は法令等に違反して使用しようとした場合、当サイト又はサプライヤーは、観光サービスの提供を拒否することができ、この場合、返金は一切認められません。

第7条 責任の制限
  1. お客様は、プラットフォームコンテンツがサプライヤーその他第三者から提供される可能性があることを理解し、当サイトがプラットフォームコンテンツの正確性に関していかなる表明又は保証も行わないことに同意します。お客様は、サプライヤーその他第三者によって提供されるプラットフォームコンテンツに対して責任を負うことを当サイトに要求しないことに同意します。
  2. お客様は、本プラットフォームを通じて連絡又は送信する内容について、第三者に不当に閲覧され、又は傍受される可能性があることに同意します。お客様は、当サイトが、本プラットフォーム上の情報セキュリティに関し、お客様に対して一切の義務及び責任を負わないことを確認します。
  3. 当サイト、サプライヤー、それらの役職員、及びそれらの代理人は、お客様の本利用規約等の不遵守、お客様による本サービス、本プラットフォーム又は観光サービスの利用行為その他のお客様の行為に起因してお客様に生じる損害について、一切の責任を負わないものとします。但し、当サイトの故意又は重大な過失によりかかる損害が発生した場合は、この限りではありません。
  4. 法律で許容される最大限の範囲において、お客様が本サービスにご満足いただけない場合の唯一の救済手段は、本サービスの利用の中止であることに同意します。いかなる事情であっても、当サイトがお客様に対して損害賠償責任を負う場合、賠償額の上限は、お客様が請求した日の直近12か月間に、お客様が当サイト及びサプライヤーに対して支払った金額の総額とします。

第8条 補償
  1. お客様は、本利用規約等の不遵守、又は、お客様による本サービス、本プラットフォーム若しくは観光サービスの利用行為に起因して、第三者の知的財産権その他の権利及び利益が侵害され、当該第三者との間で紛争が生じたときは、その責任及び費用負担によりこれを解決するものとします。かかる紛争により、当サイト、サプライヤー、それらの役職員、及びそれらの代理人に損害（訴訟費用、弁護士費用、和解費用などの損失を含みます。）が生じたときは、当該損害を賠償するものとします。
  2. 前項に定める第三者との紛争に関し、当サイトは、お客様に対し、当該第三者からの請求に対する攻撃防御、法的措置又は和解交渉の実施等を要求することができるものとし、お客様は、当サイトの求めに応じ、当該第三者との紛争の状況を報告するものとします。また、お客様は、当サイトの書面による事前の同意なしに、当サイトの利益に反する可能性のある対応を講じることはできません。

第9条 解除
お客様が本利用規約等のいずれかの条項に違反するか、又は、当サイトが、独自の判断で、必要とみなした場合、当サイトは、お客様への事前の通知なしに、お客様による本サービス及び本プラットフォームの利用を停止させることができ、また、お客様に付与したアカウントを失効させることができます。

第10条 ビザ及び保険
  1. お客様の国籍及び旅行先に関わらず、お客様は、その時点で有効な旅行先の入国規制を自身で確認するものとします。各国のビザ及び健康に関する要件は、通知なく変更される場合がありますので、出発前に最新の入国規制を確認いただくことをお勧めします。
  2. お客様自身の権利及び利益のため、利用される観光サービスの内容次第では、出発前に総合旅行保険に加入されることをお勧めします。

第11条 紛争解決
本利用規約等及びお客様と当サイトとの関係は、当サイトの事業所の所在地の法令に準拠します。お客様は、お客様による本サービス、本プラットフォーム及び観光サービスの利用に起因する紛争については、当サイトの事業所の所在地における第一審裁判所を第一審の専属的合意管轄裁判所とすることに同意します。

第12条 雑則
  1. 本利用規約のいずれかの条項が無効、違法又は執行不能と判定された場合でも、残余の条項の有効性、合法性又は執行可能性は、引き続き有効に存続するものとします。
  2. 当サイトは、本利用規約等に基づく権利及び義務を譲渡することができ、また本利用規約等に基づく義務を第三者に引き受けさせることができます。お客様は、当サイトの書面による事前の同意なしに本利用規約等に基づく権利及び義務を直接又は間接的に第三者に譲渡することはできません。

To the fullest extent permitted by law, you also agree that we may change, suspend, discontinue or terminate any services at any time and may impose regulations or restrictions on, or amend the terms of, certain services, or limit your access to any part or all of the services, without prior notice to you.
  2.2 You may incur fees and expenses which shall be paid to the Suppliers by you through your use of the ノース・スノーランド in 千歳 Service. In addition, you may be subject to the terms and conditions imposed by the Suppliers. You acknowledge and agree that you are solely responsible for all such fees and expenses, and you agree to pay all such fees and expense and abide by all such terms and conditions imposed by the Suppliers.
  2.3 We will make effort to maintain the operation of the ノース・スノーランド in 千歳 Service and the ノース・スノーランド in 千歳 Platform, but we do not guarantee that the ノース・スノーランド in 千歳 Service and the ノース・スノーランド in 千歳 Platform will always function properly or stay uninterrupted by external factors. You agree that we reserve the right to reject your visit to the ノース・スノーランド in 千歳 Platform or your use of the ノース・スノーランド in 千歳 Service, and you also agree that we reserve the right to change, suspend, discontinue or terminate the ノース・スノーランド in 千歳 Service or the ノース・スノーランド in 千歳 Platform.

  3.1 The term “Platform Content” used in these Terms of Use refers to all the materials presented or used on the ノース・スノーランド in 千歳 Platform by us, including but not limited to text, photographs, graphics, images, illustrations, video, audio, data, code and other materials. You acknowledge and agree that all of the Platform Content is the proprietary property of ノース・スノーランド in 千歳 or the licensors who license ノース・スノーランド in 千歳 to use such materials, which are protected by the relevant intellectual property laws. ノース・スノーランド in 千歳 may change, modify or remove any Platform Content without prior notice to you.
  3.2 Subject to your compliance with these Terms of Use, we hereby agree to grant you a limited, non-exclusive, non-transferable license to use or access the ノース・スノーランド in 千歳 Platform, and we may revoke this license at any time without prior notice to you. You agree to comply with relevant intellectual property laws and other applicable laws and regulations, and solely use and access the Platform Content for personal, non-commercial, entertaining purpose. You promise that, in no event, will you use, reproduce, translate, transmit, broadcast, sell, assign, create derivative works based on or in any other way exploiting the Platform Content in a way that harms ノース・スノーランド in 千歳 or the licensors who license ノース・スノーランド in 千歳 to use such materials. You also undertake not to massively copy, save or download any Platform Content in any form. In addition, you agree that you will bear all risks arising out of your use or access to any Platform Content. To the fullest extent permitted by law, we are not liable in any way for any Platform Content, including but not limited to any errors or omissions in the Platform Content. You shall be solely liable for any losses or damages suffered by any person as a result of your use or access to the Platform Content.
  3.3 You acknowledge and agree that, in the course of your use or access to the Platform Content, we may not be able to know who other third-party users you interact with, or predict or control their behavior. Therefore, we cannot guarantee the authenticity and accuracy of any contents, materials or information provided by other third-party users through the ノース・スノーランド in 千歳 Platform.

4. Information You Provide
  4.1 You hereby agree and authorize us to use your personal information in accordance with ノース・スノーランド in 千歳’s “Privacy Policy.”
  4.2 In order to collect your opinions and improve the ノース・スノーランド in 千歳 Service, you agree to accept the invitation of traveler review through SMS, email or the ノース・スノーランド in 千歳 Platform, and you can decide whether to fill out the traveler review at your own discretion. When we receive your traveler review, we have the right (but not the obligation) to upload your review to the relevant pages of the ノース・スノーランド in 千歳 Platform and to share and disclose the extent of your satisfaction and opinions. You shall ensure that the traveler review you provide is not misleading and must not contain inappropriate, defamatory, threatening, abusive and other offensive words, nor may you contain your and other persons’ personal information and information that is not related to tourist experience in nature, or other content that violates the laws and regulations.
  4.3 You understand and agree that in the course of your use of the ノース・スノーランド in 千歳 Service, the traveler review you provide, including but not limited to text, photographs, images and videos, may be used by ノース・スノーランド in 千歳, the Supplier or the users of the ノース・スノーランド in 千歳 Platform, regardless of whether such traveler review meets all the elements of a copyright under relevant intellectual property laws. Therefore, when you provide your traveler review to ノース・スノーランド in 千歳, it means that you irrevocably agree: (a) to grant ノース・スノーランド in 千歳 or the Supplier to reproduce, reformat, excerpt, modify, translate, create derivative works or otherwise use it on a non-exclusive, world-wise, royalty-free, perpetual, and sub-licensable condition, including but not limited to the promotion in any media formats and through any media channels; and (b) to non-exclusively grant the users of the ノース・スノーランド in 千歳 Platform to access, use, reproduce, create derivative works or otherwise use it reasonably for non-commercial purpose through the ノース・スノーランド in 千歳 Platform. However, your authorization, unless otherwise agreed by you in writing, will not affect your ownership of the information you provide.
  4.4 You warrant that all the information you provide (including but not limited to text, photographs, graphics and video) will not violate any laws and regulations, and will not infringe any third party’s rights, and ノース・スノーランド in 千歳 will not infringe any third party’s rights by using such information; you fully understand that you are solely responsible for all the information you provide and ノース・スノーランド in 千歳 will not be liable for any error or omission in any content.
  4.5 You expressly agree that we may, at our sole discretion, remove any information you provide from the ノース・スノーランド in 千歳 Platform.

5. Your Undertakings
  5.1 You shall use the ノース・スノーランド in 千歳 Service or the ノース・スノーランド in 千歳 Platform fully and only in accordance with these Terms of Use; you shall be solely responsible for all your behaviors of using the ノース・スノーランド in 千歳 Service or the ノース・スノーランド in 千歳 Platform.
  5.2 You shall promise the following:
    (a) You agree not to copy, reproduce, distribute, publish, display, perform, transmit or broadcast any part of the ノース・スノーランド in 千歳 Service without our prior written authorization, including, by way of example and not limitation, by doing or engaging in any of the following without our prior express written consent: (i) altering, defacing, mutilating or otherwise bypassing any approved software through which the ノース・スノーランド in 千歳 Service is made available; and (ii) using any trademarks, service marks, design marks, photographs or other content belonging to ノース・スノーランド in 千歳 or obtained from the ノース・スノーランド in 千歳 Service.
    (b) You agree not to bypass, damage or otherwise interfere with any security or other features of the ノース・スノーランド in 千歳 Service designed to control the manner in which the ノース・スノーランド in 千歳 Service is used, harvest or mine the service content from the ノース・スノーランド in 千歳 Service, or otherwise access or use the ノース・スノーランド in 千歳 Service in a manner inconsistent with individual usage.
    (c) You agree not to undertake, cause, permit or authorize the translation, reverse engineering, disassembling or hacking of any aspect of the ノース・スノーランド in 千歳 Service, including any service content available on or through the ノース・スノーランド in 千歳 Service, or attempt to do any of the foregoing, or otherwise attempt to use or access any portion of our service other than as intended by ノース・スノーランド in 千歳, except and solely to the extent permitted by these Terms of Use or other regulations.
    (d) You agree not to use, display, mirror, frame or utilize framing techniques to disclose the ノース・スノーランド in 千歳 Service, including any service content available on or through the ノース・スノーランド in 千歳 Service, or any portion thereof, through any other application or website, unless and solely to the extent we make available the means for embedding any part of the ノース・スノーランド in 千歳 Service or service content.
    (e) You agree not to access, tamper with, or use non-public areas of the ノース・スノーランド in 千歳 Service, ノース・スノーランド in 千歳’s (and our hosting company’s) computer systems and infrastructure, or the technical delivery systems of our providers.
    (f) You agree not to harass, abuse, harm or advocate or incite harassment, abuse or harm of another person or group, including our employees and other users.
    (g) You agree not to provide any false personal information, create a false identify, or impersonate another person or entity in any way.
    (h) You agree not to solicit, or attempt to solicit, personal information from other users.
    (i) You agree not to restrict, discourage or inhibit any person from using the ノース・スノーランド in 千歳 Service, disclose personal information about a third person on the ノース・スノーランド in 千歳 Service or obtained from the ノース・スノーランド in 千歳 Service without the consent of such person, or collect information about our users.
    (j) You agree not to use the ノース・スノーランド in 千歳 Service to communicate or facilitate any commercial advertisement or solicitation, except as expressly permitted in these Terms of Use.
    (k) You agree not to engage in any fraud, breach of the information security of ノース・スノーランド in 千歳 Platform, crack the passwords of other users, transfer or illegally save the data or engage in any other illegal activities.

6. Order Confirmation and Refund Policy
  6.1 You can select and purchase tour itineraries, transportation services, tickets and other travel experience related services provided by ノース・スノーランド in 千歳 or the Supplier in a specific currency through the ノース・スノーランド in 千歳 Platform. Except for certain orders which will be confirmed immediately after you place your order, other orders must be confirmed by ノース・スノーランド in 千歳 or the Supplier afterwards. You agree to receive notification of successful bookings/orders via SMS, email or mobile applications, and you acknowledge and agree that the time it takes to reply the result of your bookings/orders as indicated on the ノース・スノーランド in 千歳 Platform is for reference only. You also agree that the time it takes to confirm the success of your bookings/orders may be adjusted based on the actual situation.
  6.2 ノース・スノーランド in 千歳 reserves the right to change or adjust the prices and fees of tour itineraries, transportation services, tickets and other travel experience related services provided by ノース・スノーランド in 千歳 or the Supplier at any time. These changes may be announced via SMS, email, the website and mobile applications. If you use the ノース・スノーランド in 千歳 Service after the notice of such changes, it means you agree and accept the changed prices and fees.
  6.3 You agree that ノース・スノーランド in 千歳 may, at our sole discretion, refuse or cancel any booking or order that may violate these Terms of Use.
  6.4 You agree that you will pay your bookings/orders in accordance with the payment method we accept; you acknowledge and agree that we are not obligated to process or execute your bookings/orders until you complete the payment in accordance with the payment process instructed by us. Unless otherwise provided in these Terms of Use, the payment for orders/bookings made by you is non-refundable.
  6.5 In the case that the service you selected and purchased is provided by a Supplier instead of ノース・スノーランド in 千歳, such Supplier will accept or reject your booking/order on its own, and be responsible for providing all related services. If you have any questions about the content of the service provided by the Supplier, you may first ask the Supplier to obtain the most direct information; but you can also contact ノース・スノーランド in 千歳, and we will try to contact the Supplier to find a solution.
  6.6 You acknowledge and agree that the specific service provided by any Supplier may result in additional taxes or fees and expenses depending on the actual situation, and you may also be obligated to pay the relevant amount directly to the Supplier or the tax authority. Although we have requested the Supplier to provide the latest and accurate conditions of use, restrictions, prices and other information with respect to the services they provided, ノース・スノーランド in 千歳 cannot warrant that all content displayed on the ノース・スノーランド in 千歳 Platform will be accurate at all times. If your order/booking is cancelled by the Supplier, ノース・スノーランド in 千歳 will notify you as soon as possible in a reasonable manner.
  6.7 If you contact us or the Supplier to cancel your order/booking within the cancellation period indicated on the ノース・スノーランド in 千歳 Platform at the time of your order/booking, after you have successfully cancelled and received our notice, or if the service you selected and purchased is cancelled according to the conditions and restrictions set by ノース・スノーランド in 千歳 or the Supplier, the payment you made will be refunded to you in the same way as you paid. You fully acknowledge and agree that the amount of refund you may receive may differ from the amount you originally pay due to the foreign exchange rate, or the administration fees or service fees collected by the credit card company or the payment processor.
  6.8 Use of E-Voucher
    6.8.1 If you select and purchase tour itineraries, transportation services, tickets and other travel experience related services through the ノース・スノーランド in 千歳 Platform, after the order/booking is successful, except for providing physical vouchers or under other circumstances, you will receive a SMS or email confirming your order/booking, which will include the number of your order/booking and an electronic voucher (“E-Voucher”) that recognizes the service you have purchased. You must print out your E-Voucher for the use of your E-Voucher.
    6.8.2 You acknowledge and agree that you must comply with the additional conditions and restrictions of E-voucher set by ノース・スノーランド in 千歳 and the Supplier, including but not limited to that: you must show up in person and on time at the meeting point designated by ノース・スノーランド in 千歳 or the Supplier within the period of use specified in the E-Voucher, and present documents or materials requested by ノース・スノーランド in 千歳 or the Supplier (e.g., an identification document with your photo, the number of your order/booking, your E-Voucher). If you are unable to meet the conditions and restrictions set by ノース・スノーランド in 千歳 or the Supplier, you may not be able to redeem the content of the service recognized by the E-Voucher and no refund will be granted.
    6.8.3 You acknowledge and agree that if your E-Voucher or the number of your order/booking is lost or stolen, ノース・スノーランド in 千歳 or the Supplier has no obligation to reissue the E-Voucher or provide you with the content of the service recognized by the E-Voucher. In addition, if you attempt to redeem an E-Voucher illegally, for example, if you do not meet the legal age for the use of an E-Voucher recognizing a certain content of service, ノース・スノーランド in 千歳 or the Supplier may refuse to accept your redemption of the E-Voucher and no refund will be granted.

7. Limitation of Liability
  7.1 You understand that the Platform Content may be provided by the Supplier and agree that we do not provide any representation or warranty regarding the accuracy of the Platform Content. You agree that you will not ask ノース・スノーランド in 千歳 to be responsible for any Platform Content provided by the Supplier in the future.
  7.2 You agree that any content you contact or transmit with the ノース・スノーランド in 千歳 Platform is not confidential, and that your communications may be read or intercepted by others. You acknowledge and confirm that there is no confidential, trust or other cooperative legal relationship created between you and ノース・スノーランド in 千歳.
  7.3 To the fullest extent permitted by law, you agree that ノース・スノーランド in 千歳 and our directors, senior managers, officers, employees and agents of such personnel are not responsible for any of your direct, indirect, special, incidental, punitive, exemplary or derivative damages arising out of their non-compliance of these Terms of Use and their use of the ノース・スノーランド in 千歳 Platform or other acts of negligence.
  7.4 To the fullest extent permitted by law, you agree that if you are not satisfied with the ノース・スノーランド in 千歳 Service, your sole remedy is to stop using the ノース・スノーランド in 千歳 Service. In any event, if we have any liability to you, the maximum amount of compensation is the total amount you paid to us within the 12 months prior to your initial claim.

8. Indemnification
  8.1 You shall indemnify and hold harmless ノース・スノーランド in 千歳 and our directors, senior managers, officers, employees and agents of such personnel from all losses or damages arising out of any third party’s claim for non-compliance of these Terms of Use or the infringement of any intellectual property or any right of others due to your access to the ノース・スノーランド in 千歳 Platform or your use of the ノース・スノーランド in 千歳 Service, or those who use your ノース・スノーランド in 千歳 Member Account. If any of ノース・スノーランド in 千歳 and our directors, senior managers, officers, employees and agents of such personnel suffers any losses or damages, you shall indemnify them, including but not limited to litigation fees, attorney fees, settlement fees and other losses.
  8.2 With respect to a claim filed by a third party mentioned above, ノース・スノーランド in 千歳 may ask you to defend against any claim or take legal action, and to conduct any settlement negotiations. However, without our prior written consent, you may not take any legal action which may be adverse to our rights.

9. Termination
  9.1 These Terms of Use will apply to you and ノース・スノーランド in 千歳 until ノース・スノーランド in 千歳 terminates these Terms of Use. In the event that you violate any provision of these Terms of Use or ノース・スノーランド in 千歳 deems necessary at our sole discretion, we may terminate or suspend your use of the ノース・スノーランド in 千歳 Service, and your access to the ノース・スノーランド in 千歳 Platform or your ノース・スノーランド in 千歳 Member Account, without any prior notice to you.
  9.2 If these Terms of Use shall terminate in accordance with Section 9.1, you agree that, to the fullest extent permitted by law, we bear no obligation and liability to you, and may cancel any confirmed order prior to the termination without any refund payment to you.
  9.3 You acknowledge and agree that any provision of these Terms of Use shall, by its nature, survive termination, including but not limited to the Limitation of Liability.

10. Visa and Insurance
  10.1 Regardless of your nationality and destination, you shall check the now effective entry regulations of your destination on your own. Since the visa and health requirements in different countries may be subject to changes without any notice, we recommend that you double-check the relevant current regulations prior to your departure.
  10.2 For your own rights and benefits, we recommend that you purchase a comprehensive travel insurance policy prior to your departure.

11. Dispute Resolution
These Terms of Use and your relationship with ノース・スノーランド in 千歳 are governed by the laws of business office of ノース・スノーランド in 千歳. You agree that any controversy and dispute arising out of your use of the ノース・スノーランド in 千歳 Service shall be submitted to the trial court of the business office of ノース・スノーランド in 千歳 for the first instance.

12. Miscellaneous
  12.1 If any provision of these Terms of Use is held to be invalid, illegal or unenforceable, the validity, legality or enforceability of the remaining provisions shall remain in full force and effect.
  12.2 We may assign these Terms of Use or any right and obligation hereunder, and may delegate any obligation hereunder, to any third party. Without our prior written consent, you may not directly or indirectly assign these Terms of Use or any right and obligation hereunder to any third party.
